TERMS & CONDITIONS

PREAMBLE

a. GLOBAL TALENT ART PRIZE (hereinafter “GTAP”) is an international art prize, aims to support visual arts by discovering and promoting talented artists to provide all worthy participants with a winner reference and giving them the opportunity to showcase their work at a broad international level.

b. The services (the “Service”) offered at GLOBALTALENTPRIZE.ART (the “Site”) is owned and operated by GLOBAL TALENT ART PRIZE (hereinafter “GTAP”) are provided to you under the Rules—these Terms & Conditions. BY USING THE SERVICE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH HEREIN. Please review the following terms carefully. If you do not agree to these terms, you should not submit any art to any of their art competitions and art exhibitions, obtain goods, products or services from this Site.

c. The Rules outlined on this Site may be amended at any time by GTAP without any specific notice to you. The latest and most current version of the Rules will be posted on this Site, and you should review the Rules prior to any use of this Site.

d. The GTAP is responsible for overseeing the Competition in accordance with the Rules hereby formulated by the GTAP.

e. The only selection criterion considered by the GTAP is artistic.

f. The GTAP will treat all Participants of the Competition in a fair, equal and transparent manner. The GTAP will not discriminate against any Participant for any reason.

g. The GTAP is open to any living adult person who submitted their application without impose based on nationality, or place of residence.

1. SUBMISSION

1.1. A call for submissions was published on the www.globaltalentprize.art website and announced on the Web in general.

1.2.The Participant makes a Submission by completing the form and attaching the required documentation on the Competition Website.

1.3. Out of concern for equity among applicants, the application form is standardized. Consequently, documents or information other than that requested in the online application form may not be provided.

1.4. All attached files and providing information must meet the specified requirements of the Participant’s Submission form rules on website of Competition.

1.5. Any Participant’s Submission form which fails to meet either of the criteria specified below of the Competition Rules or Rules on the Competition website, especially any requested information submitted solely in the form of a website link, will be rejected outright by the GTAP.

1.6. Consents, the granting of which is voluntary, but at the same time necessary for the acceptance of the Submission. The consents refer to one’s acceptance of the Terms and Conditions (ticked checkbox);

1.7. The Submission is confirmed by pressing the button called ‘Submit’ that delivers the Submission to the GTAP.

1.8. In the event of errors in the Submission, the GTAP, in its sole discretion, may contact the Participant with information about any errors that prevent or impede the assessment of the Submission and may give the Participant additional time to amend the Submission.

1.9. Participant can not update or change their application form after submission.

1.9. Participant must present from 1 to 6 artworks in their application form.

1.10. Any candidate who provides untrue information, is not the author of the works presented, or have insulted the other candidates, help center staff, the final jury or the GTAP, or in have a disrespectful attitude in general will be banned from entering the contest for life.

1.11. Participation in the Competition is chargeable.

1.12. The entry fee is $15.00 for 1 to 3 entries and $23.00 for 4 to 6 entries.

1.13. There Is No Return or Refund of Any Entry Fees.

2. COMPETITION DATES.

2.1. The competition starts on the date announced on Competition website page.

2.2. The submission Deadline of entries determined in accordance with the conditions specified on the competition website page.

2.3. The time of delivery of the Submission on the GTAP’s server is deemed decisive, not the time of dispatch. Submissions received after this deadline will not be taken into consideration.

3. Role of the Jury.

3.1. Juror can be a natural person who is a member of the Jury chosen by the GTAP who selects the winners and award winners of the Competition together with the other Jurors.

3.2. The GTAP is awarded by a final independent jury to the winners.

3.3. The selection of winners and award winners is based on a subjective evaluation of the Submissions by the jury members based on their knowledge, experience and their artistic achievements or achievements in the visual arts.

3.4. The decision on the selection of the winners and award winners is binding and final and is not subject to any complaint.

4. AWARDS

4.1. GTAP does not provide individual advice on the application forms but is in charge of identifying worthy artists who participated in the contest.

4.2. Winners and award winners of the Competition receive the prizes in accordance with the specified on the Competition website page.

4.3. GTAP issues a certificate of artistic merit of participation to all artists who distinguished themselves from a qualitative perspective, whether or not they are finalists.

4.4. The winner certificate is send individually via e-mail. It contains a forgery-proof digital signature to provide exclusivity of authenticity and prestige.

4.5. The objective of the certificate is to provide official recognition from the GTAP to artist participants whose merit and artistic talent have been specifically noted.

4.6. Not all participants will necessarily receive a certificate.

4.7. The list of winners and award winners of the Competition will be published on the GTAP ‘s website and respective social media channels. In addition, this information may be published in the press, collaborating institutions or partners.

4.8. The Participants who are the winners and award winners of the Competition will be informed of that fact individually via e-mail.

5. MEDIA OBLIGATIONS.

5.1. The winners of the Competition are obliged to give an interview and provide portfolio and any other required additional information and photographs to the editor to promoting and featuring the winners no later than 2 weeks after the results of the Competition are announced.

5.2. Within 2 months of the announcement of the results of Competition, the winner undertakes not to refuse, without good reason, other press interviews or public appearances in the media.

6. USE OF INFORMATION.

6.1. GTAP reserves the right, and you authorize us by using our Site, to use and assign all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy. Our Privacy Policy, as it may change from time to time, is a part of the Rules. You further agree that by supplying public information including but not limited to text and images, you are giving GTAP the rights to display this public information on the site due to you participating in any of art competitions, art exhibitions, posts, pages, special sections and in all of the Site’s marketing efforts. The artist retains all rights to their supplied text and images, but GTAP reserves the right to edit or remove offensive or otherwise illegal images or text from its site.

7. COPYRIGHT

7.1. The Participant, upon submitting their entry to the Competition, grants to the GTAP a non-exclusive license to the works included in the Submission, i.e. photographs of the author’s works.

7.2. The licence is granted for an unlimited territorial area.

7.3. The licence is granted for an indefinite period of time.

7.4. By accepting the Terms & Conditions, the Participant declares that:

7.4.1. They own the author’s economic rights and are authorised to dispose of the works.

7.4.2. The works are not encumbered by third party rights.

7.4.3. In the case of works created with other persons, these persons have consented to the inclusion of the works in the Competition Submission and to the granting of this licence.

7.5. The licence is granted in the following fields of exploitation:

7.5.1. In terms of recording and multiplying the works — making copies using digital techniques in order to distribute the works to the Competition Jury, posting their photographs on the websites and social media profiles of the GTAP, as well as in the press magazine published by the GTAP, with the sole aim to promote and provide information about the Competition.

7.5.2. Dissemination of works — entering works into computer memory, placing them in printed materials and on the Internet, websites and social media profiles of the GTAP, with the sole aim to promote and provide information about the Competition, as well as deliver the works to the Competition Jury.

7.6. The Participant takes full responsibility for infringement of third party rights. Should a third party assert claims against the GTAP, the Participant undertakes to indemnify the GTAP to the fullest extent permitted by UK law. Upon receipt of notification of a claim, the Participant shall, if possible, join the pending dispute or settlement negotiations and, in the event that the claim is recognised by a court in a final judgment, reimburse the GTAP Founder for any penalties or damages imposed in relation to the infringement of third party rights. In the event of a settlement, the Participant shall reimburse the GTAP for the amount agreed in the settlement.

7.7. The works will not be used for any purpose other than the ones mentioned in the Terms & Conditions.

7.8. In particular, all winning entries will be published on the GTAP websites.

7.9. Each Submission becomes part of the archived online ‘catalogue’ of the Competition accessible only to the GTAP. It can be removed at a later date upon the Participant’s request.

7.10. GTAP may color correct your images in order to enhance the overall presentation. GTAP may crop your images for formatting purposes for use in GTAP presentations and for other areas of the website if your images are chosen.

7.11. Any use of the works included in the Submission that is not covered by the licence will be consulted with the Participant.

8. COMPLAINTS.

8.1. Any complaints related to the Competition can be made by sending an e-mail to info@globaltalentprize.art

8.2. The complaint should contain the name, surname and return e-mail address of the Participant. In addition, the complaint should specify the type of inconsistency and one’s expectations regarding the fulfilment manner of obligations assumed by the GTAP.

8.3. The GTAP shall respond to the complaint immediately, no later than within 21 calendar days. The answer of the GTAP to the complaint shall be sent to the e-mail address provided by the Participant or delivered in another manner specified by the Participant.

9. FINAL PROVISIONS.

9.1. The Terms and Conditions are governed by international law.

9.2. The GTAP shall not be responsible for the incompleteness, unsuitability, destruction or loss of the Submission, which may result in the Submission being deemed ineligible for the Competition. Furthermore, the GTAP shall not be liable for any human error or technical issues related to computer equipment, software or the Internet connection that result in the entry not being considered, the Competition’s limitation or impossibility of its continuation.

9.3. The Site may contain links to other Web sites. We are not responsible for the content, accuracy or opinions expressed in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. The inclusion of any linked Web site on our Site does not imply approval or endorsement of the linked Web site by us. If you decide to leave our Site and access these third-party sites, you do so at your own risk.

9.4. The GTAP shall be entitled to suspend or terminate the Competition in whole or in part at any time, for any reason, without awarding any prizes.

9.5. Participant right to use the Site is not transferable. Any password or right given to you to obtain information or documents through the use of the Services is not transferable.

9.6. By participating, the artist acknowledges that they are familiar with these regulations and expressly accept them without reservation.
